(1) If it is necessary to use or acquire someone else's real estate for generating, transmitting or distributing electricity, the person who has obtained the permit may submit an application to the Government of Nepal.
(2) If the application as per sub-section (1) is received, the Government of Nepal may acquire such real estate to the person who has obtained the permit as if it had acquired the land to the organization organized according to the prevailing law after conducting the necessary investigation in this regard. If there is government land, it will be provided on lease for the duration of the permit.
(3) The Government of Nepal or a person who has obtained a permit may prohibit the use of any construction work related to the production, transmission or distribution of electricity by the place where such construction work takes place or the real estate within a specified distance around that place so that no one else can use it for the purpose of any specific work. For the loss caused to the concerned person due to the prohibited reasons, the Government of Nepal or the person who has received the permit will give compensation as prescribed.
